Legal Rights of Birth Mothers in Texas
Texas birth mothers have important legal rights. They may:
- Choose whether to place their child for adoption. It is your choice.
- Select the adoptive parent or parents based on the values that matter to you.
- Consent to adoption after the child is born.
- Accept financial help during pregnancy.
- Have an open or closed adoption, with conditions they choose.
- Create an adoption plan to allow for updates on the child in the future.
You may also receive counseling and emotional support both before and after the adoption.
The Adoption Process
A birth mother may consent to adoption 48 hours after their child is born. You can make an adoption agreement at any time during pregnancy, and you may select the adoptive parents.
However, you don’t sign the adoption paperwork until after the child is born.
The father must register within 31 days of the child’s birth. If he fails to register, the adoption may proceed without his consent.
As the birth mother, you have a significant amount of choice in how the adoption proceeds.
Texas mothers choose both open and closed adoptions. You may work with the adoptive parents to decide whether to receive information about your child or have contact as the child grows.
The adoptive parents must be at least 21 years old, must be financially stable, and must complete background checks. They must also do a home study showing their fitness for adoption.
After the child is born, the Texas birth mother formally consents to the adoption. The child is placed with their adoptive family, and the adoption will be approved by the family court.
